Terms of Service

1. Acceptance
By creating a PinAppAI account, installing the PinAppAI widget on a website you control, downloading the PinAppAI desktop app, or otherwise using the PinAppAI service (the “Service”), you agree to these Terms. If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and “you” refers to that entity.
2. The service
PinAppAI provides a feedback widget, an admin dashboard at app.pinappai.com, a desktop application, and supporting APIs that let your team and reviewers leave structured, locator-precise change requests on live web pages.
3. Account eligibility
- You must be at least 16 years old to create an account.
- You must provide accurate registration information and keep it current.
- You are responsible for safeguarding your account credentials and for all activity under your account.
- One account per person; one workspace may have multiple members.
4. Plans and billing
Current plans, limits, and prices are published at /pricing/ and may change. When paid plans are active, billing is processed by Lemon Squeezy as merchant of record. EU consumers have a statutory 14-day right of withdrawal from the purchase of digital services unless performance has begun with explicit consent and the consumer has acknowledged loss of withdrawal rights, as required by Article 16(m) of Directive 2011/83/EU.
5. Acceptable use
Your use of the Service is subject to our Fair Use Policy, which is incorporated into these Terms by reference. Material breaches of the Fair Use Policy are grounds for suspension or termination.
6. Customer responsibilities (when acting as data controller)
When you embed the PinAppAI widget on a site you control, you are the data controller for end-user feedback collected through that widget, and PinAppAI is your processor under the Data Processing Agreement. You are responsible for:
- Providing notice to your end users about the data being collected;
- Establishing a lawful basis under GDPR Art. 6 for the processing;
- Not collecting special-category data (Art. 9) through the widget without appropriate safeguards;
- Configuring the widget’s allowed-origins list so it cannot be embedded on domains you do not control.
7. Intellectual property
- Our IP: PinAppAI, its name, logo, marketing site, admin dashboard, API, and widget code are owned by us. We grant you a limited, non-exclusive, revocable license to use the Service in accordance with these Terms.
- Your data: You retain ownership of your account data and any feedback collected through your widgets. You grant us a limited license to host, copy, transmit, and display your data solely to provide the Service.
- Open-source desktop builds: The desktop installers we publish at pinappai-desktop-releases are distributed under the license stated in that repository.
8. Service availability
We aim for high availability but make no service-level guarantee on the Free plan. Paid plans may be covered by service-level commitments published at /pricing/ or in a separately-signed order form.
9. Suspension and termination
We may suspend or terminate your account for: material breach of these Terms or the Fair Use Policy; non-payment after notice; legal compulsion; or to protect the security of the Service. You may terminate at any time by deleting your account from the dashboard. After termination, your data export remains available for 30 days; thereafter we delete it in accordance with our Privacy Policy and DPA.
10. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, PinAppAI’s aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of: (a) the fees you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred US dollars (USD 100). This cap does not apply to liability for gross negligence, willful misconduct, fraud, or where prohibited by applicable law.
12. Indemnity
You agree to indemnify and hold PinAppAI harmless from claims arising out of: (a) your misuse of the widget on third-party sites without proper notice or lawful basis; (b) content you submit through the Service that infringes third-party rights; or (c) your breach of these Terms.
13. Governing law and venue
These Terms are governed by the laws of the Republic of Türkiye. Disputes shall be brought before the Istanbul Çağlayan courts and enforcement offices, except that consumers domiciled in the EU or UK may bring proceedings in their place of domicile to the extent required by mandatory consumer protection law.
14. Changes
We may update these Terms from time to time. Material changes will be communicated by email to account holders at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
